The United States Court of Appeals for the Fifth Circuit asked the Louisiana Supreme Court: “What is the meaning of ‘good faith’ as that term is used in the Louisiana Environmental Quality Act, Louisiana Revised Statutes 30:2027?” Eric Borcik was employed by Crosby Tugs, L.L.C. (Crosby) as a deckhand. In July 2010, he was transferred to the M/V NELDA FAYE. Borcik claims that the lead captain of the NELDA FAYE ordered him to dump waste oil into navigable waters and otherwise violate environmental laws over a period of three years. He further claims that he followed these orders. In May 2013, Borcik emailed Crosby’s Chief Administrative Officer (CAO). His email communicated that he had “concerns” that he stated “have all fallen on deaf ears” and expressed “fear [of] some form of retaliation.” He later met with the CAO in person. Borcik was transferred to another boat and later fired. Borcik contends he was fired in retaliation for his complaints; Crosby contends that Borcik was fired for insubordination. Borcik sued Crosby in October 2013, alleging retaliatory termination in violation of Louisiana Environmental Quality Act (“LEQA”), specifically claiming that Crosby violated the Louisiana Environmental Whistleblower Act. The Supreme Court answered the certified question: the term “good faith,” as used in R.S. 30:2027, means an employee is acting with an honest belief that a violation of an environmental law, rule, or regulation occurred. Plaintiff filed suit under the Fair Labor Standards Act (FLSA), 29 U.S.C. 201 et seq., against Defendants Galliano Marine Service and C-Innovation, seeking to recover unpaid wages for overtime worked during his employment at C-Innovation. Defendants run a remotely operated vehicle (ROV) business for offshore applications and employed plaintiff as an ROV Technician and ROV Supervisor. The district court granted summary judgment against plaintiff. The court concluded that the district court erred in granting defendant's motion for summary judgment because it has not been established as a matter of law that the seaman exemption applies. In this case, competing testimonial evidence regarding whether plaintiff was a master or subject to the authority, direction, and control of the master aboard a vessel precludes summary judgment. Furthermore, the district court must determine what proportion of plaintiff's time is spent on seaman's work. Accordingly, the court reversed and remanded for further proceedings. View "Halle v. This consolidated case under the Jones Act, 46 U.S.C. 883, and general maritime law, involved an accident on a barge in the navigable waterways of Louisiana. Defendant, the barge owner, appealed the district court's judgment for plaintiffs. The court held that evidence supported the district court's award to plaintiff McBride for pre-death fear and conscious pain and suffering, and the district court's award of damages for loss of past and future support was not clearly erroneous. The court also concluded that the district court's award of future cure until plaintiff Touchet reaches maximum medical improvement and for future medical expenses beyond Touchet's maximum medical improvement was not reversible error. Finally, the district court did not clearly err in finding that Touchet was permanently disabled and by awarding damages for lost earnings. Accordingly, the court affirmed the judgment. Allan Tabingo was seriously injured while working aboard a fishing trawler owned and operated by American Seafoods Company LLC and American Triumph LLC (collectively American Seafoods). Tabingo alleged the lever used to operate a hatch on the trawler's deck broke when an operator tried to stop the hatch from closing. The hatch closed on Tabingo' s hand, leading to the amputation of two fingers. He brought numerous claims against American Seafoods, including a general maritime unseaworthiness claim for which he requested punitive damages. American Seafoods argued that as a matter of law, punitive damages were unavailable for unseaworthiness claims. The issue of whether punitive damages were available for a claim of unseaworthiness was a question of first impression for both the United States and Washington State Supreme Courts. The United States Supreme Court recently held that punitive damages were available for maintenance and cure, another general maritime claim. The Court held that because both the claim and the damages were historically available at common law and because Congress had shown no intent to limit recovery of punitive damages, those damages were available. Here, the Washington Court followed the United States Supreme Court's rationale and found that, like maintenance and cure, punitive damages were available for a general maritime unseaworthiness claim. Jamie Rogers, a seaman, was injured on a fishing vessel owned and operated by Block Island Fishing, Inc. Block Island made some “maintenance and cure” payments to Rogers. Block Island then brought this suit against Rogers to dispute the duration and amount of maintenance and cure payments that it owed. Block Island filed a motion for summary judgment. The district court found that November 18, 2014 was the date on which Block Island’s obligations ended and reserved for a jury to determine the exact sum that Block Island owed Rogers for his living expenses. The court then ruled that Block Island had overpaid Rogers and that Block Island could offset the sum of overpayment against any damages award that Rogers might win at trial. The First Circuit affirmed in part and vacated and remanded in part, holding (1) the district court erred by sua sponte replacing Block Island’s proposed date of July 31, 2014 with its own date without giving Rogers sufficient notice of opportunity to make his case against the new date; and (2) Block Island may offset any overpayment against Rogers’ potential damages award but may not sue for the sum in an independent action. The Waterfront Commission of New York Harbor is a bi-state corporate and political entity created by interstate compact in 1953, after years of criminal activity and corrupt hiring practices on the waterfront N.J.S. 32:23-1; N.Y. Unconsol. Laws 9801. In 2013 the Commission opened its Longshoremen’s Register to accept applications for 225 new positions, requiring shipping companies and other employers to certify that prospective employees had been referred for employment compliant with federal and state nondiscrimination policies. Rejecting a challenge, the district court held that the Commission had acted within its authority and had not unlawfully interfered with collective bargaining rights. Such rights were not completely protected under the language of the Compact. The Third Circuit affirmed, noting that opponents had ample notice and opportunity to be heard with respect to the nondiscrimination amendment. Compact Section 5p-(5)(b) clearly provides for inclusion of registrants under “such terms and conditions as the [C]ommission may prescribe.” View "NY Shipping Ass'n, Inc. v. Scott Walter Maziar sustained injuries while on board a ferry operated by the Washington State Department of Corrections (DOC). Maziar used the ferry to get to and from work. Since Maziar was injured at sea, he brought a general maritime negligence claim against the DOC. He initially requested a jury trial, but he moved to strike his demand because he thought that no jury trial right existed for general maritime negligence cases. The DOC objected, but the trial court agreed with Maziar, struck his jury request, and awarded him damages after a bench trial. The Court of Appeals affirmed the trial court on the jury trial issue but on different grounds, holding that although a jury trial right generally applied to general maritime negligence actions in state court. The State did not have a constitutional or statutory jury trial right in tort actions. The issue this case presented on appeal was whether the State had a jury trial right in tort actions. The Court held that it does: several statutes read together demonstrate that the legislature meant to treat the State as if it were a private party with regard to matters of civil procedure and confer on any party (including the State) the right to have a jury determine most matters of fact. Hicks was a deckhand on a tugboat when, while handling heavy gear, he injured his shoulder. A company doctor determined that Hicks was not fit for duty. His employer acknowledged its obligation to pay maintenance and cure and medical expenses until full recovery, maximum improvement, or until his condition was declared permanent, 46 U.S.C. 30104 (Jones Act). Hicks had surgery and physical therapy. His employer hired an investigator to videotape Hicks surreptitiously. The video showed Hicks planting a small tree and playing with his grandson. When Hicks’s doctor requested funding for an MRI scan, he was shown this footage and told that Hicks’s job required only light lifting. The doctor determined that Hicks was fit for duty. The employer terminated payments. Hicks consulted a second doctor, who diagnosed a recurrent rotator cuff tear and recommended another surgery plus rehabilitation. Under financial pressure, Hicks returned to work and missed physical therapy. His house went into foreclosure, and he was unable to pay for health insurance. Hicks sued, claiming negligence under the Jones Act and the maritime doctrines of unseaworthiness and maintenance and cure. The jury awarded $190,000 for past and future maintenance and cure and $132,000 for pain and suffering. Based on a finding that the failure to pay was unreasonable and willful, Hicks was awarded $123,000 in punitive damages and $112,083.77 in attorney’s fees. The Second Circuit affirmed. View "Hicks v. Plaintiff, the captain of a crew boat, filed suit against his employer and his supervisor under the Jones Act, 46 U.S.C. 50101, and general maritime law, seeking maintenance and cure and damages. All parties cross-appealed the district court's judgment. The court concluded that the district court's finding that plaintiff merely strained his back while lifting a hatch cover is not clearly erroneous; the district court's findings regarding the weather and condition of the seas at the time and location of the incident are not clearly erroneous; the district court properly ruled against plaintiff on all of his unseaworthiness claims; the district court's finding that defendants were not negligent is fully supported by the record; the court vacated the maintenance and cure award against the supervisor where the maintenance and cure duty extends only to the seaman's employer; and the McCorpen v. Central Gulf Steamship Corp. rule precludes plaintiff from obtaining maintenance and cure from his employer in this case. Accordingly, the court affirmed the judgment to the extent the district court rejected plaintiff's Jones Act negligence and unseaworthiness claims; vacated the awards against the employer and supervisor in their entirety; and rendered judgment in favor of the employer and supervisor. The district court declined to decide as a matter of law whether nine individual plaintiffs, former vessel-based tankermen on Blessey barges, were exempt from the Fair Labor Standards Act (FLSA), 28 U.S.C. 1292(b), as seamen. Blessey filed this interlocutory appeal challenging the district court's denial of its motion for summary judgment. The court concluded that the district court erred when it determined that Owens v. SeaRiver Maritime, Inc. required it to hold that loading and unloading duties performed by vessel-based tankermen were nonseaman duties as a matter of law; instead, the court's review of the relevant law and undisputed facts lead it to conclude that loading and unloading was seaman work when done by these vessel-based plaintiffs; and, consequently, the district court erred when it denied Blessey's motion for summary judgment on this issue. In this case, the tankermen performed duties crucial to the mission and purpose for the unit tow and were at all times engaged in work regarding the safe and efficient operation of a "vessel as a means of transportation" under 29 C.F.R. 783.31.
